On January 26th the International Court of Justice (ICJ) ruled that South Africa presented a factually plausible case for genocide with respect to Israel’s 16-week assault on Palestinians in Gaza and, consequently, ordered that Israel take immediate actions to reduce the risk of genocide.
The ICJ ruling de facto imposes legal responsibilities on all 153 state (country) signatories to the Genocide Convention; that is, all 153 countries must now act to deter/degrade Israel’s assault on Gaza that plausibly comprises genocide of the Palestinians. Such actions could include economic sanctions, embargos, freezing assets, canceling military contracts.
However, the US instructs these countries that international law, humanitarian law, and the Genocide Convention do not apply to Israel – in effect, dismissing the ICJ authority. US insists that 153 countries join US complicity with genocide.

On Tuesday January 30th, US District Court Judge Jeffrey White ruled he did not have jurisdiction to rule on a lawsuit against the US brought by Palestinians charging genocide and asking for relief. The Center for Constitutional Rights represents the plaintiffs.

In his order dismissing the case, Judge White expressed regret that he was constrained by jurisdictional precedents and wrote:
“There are rare cases in which the preferred outcome is inaccessible to the Court. This is one of those cases. The Court is bound by precedent and the division of our coordinate branches of government to abstain from exercising jurisdiction in this matter. Yet, as the ICJ has found, it is plausible that Israel’s conduct amounts to genocide. This Court implores Defendants [Biden, Blinken, Austin] to examine the results of their unflagging support of the military siege against the Palestinians in Gaza.”

On Democracy Now! February 2nd program, Amy Goodman spoke with Dearborn Michigan Mayor Abdullah Hammoud and pollster James Zogby, president of the Arab American Institute, about Biden’s support amount Arab Americans. Hammoud was part of a group of Arab American leaders and elected officials who declined to meet with Biden’s campaign manager, Julie Chávez Rodríguez, when she traveled to Dearborn. Zogby reported that Biden’s support among Arab Americans has gone from 59% in 2020 to 17% end of last October, and is likely even less now.
Dearborn Mayor to Biden: “Lives of Palestinians Should Not Be Measured Simply in Poll Numbers.” Mayor Hammoud commented:
You know, the stand that we took was sending the message that this is not a moment that calls for electoral politics. Over the course now of coming close to 120 days, Israel has murdered more than 27,000 Gazans and displaced over 2 million. And for us, the lives of Palestinians should not be measured simply in poll numbers. We want to have meaningful dialogue with senior decision-makers and policymakers who have the ability and the openness to change course in what’s unfolding overseas. I will not entertain conversations about elections while we watch a live-streamed genocide backed by our government.
James Zogby commented:
I think that the White House is taking for granted that they’ve got support. And they don’t. They don’t have ears on the ground. People who are doing the outreach for them don’t have ears to hear what the community is saying, or simply don’t want to go back and tell their bosses this is what the community is saying.
The result is, is that they’re cut off from reality. They’re cut off from reality that’s taking place on the ground. I mean, it is a genocide. It is unfolding. They told us they were going to do it. They’ve done it. We’re watching it play out every single day. And yet the administration response is, “Oh, we’re urging them to be careful about civilians, and we’re telling them humanitarian aid needs to come through.” It’s not coming through.
